OLD LYME ZONING COMMISSION
PUBLIC HEARING
Monday, March 9, 2015

The Old Lyme Zoning Commission held a Public Hearing on Monday, March 9, 2015, at 7:30 p.m. in the Auditorium of Memorial Town Hall.  Those present and voting were:  Jane Cable, Chairman, Jane Marsh, Secretary, Gil Soucie, regular member, Joan Bozek arrived at 7:35 p.m. regular member and Stacy Winchell, alternate.

Also present:  Keith Rosenfeld, Land Use Coordinator

Chairman Cable called the Public Hearing to order at 7:32 p.m.   

  • Special Permit Application to permit a Connecticut Water Company Well Station to be located at 216 Mile Creek Road, Connecticut Water Company, applicant.
Chairman Cable noted that the Public Hearing was continued for Inland Wetlands input from the January Meeting.

Mr. Rosenfeld stated Inland Wetlands found that it is permitted as a right.  Ms. Marsh noted that Exhibit E is the letter from inland wetlands, which she read for the record.  She also read a letter from the Town Sanitarian.

Chairman Cable noted that one neighbor worried about her well running dry.  She questioned whether there is any procedure to be put in place for addressing neighbor problems.

Mr. Meder stated that they should be done through the Sanitarian.  He noted that in their well approval it states that if their draw is affecting others there is redress through the Sanitarian.  Ms. Bozek stated that she feels that leaves it open-ended.  Chairman Cable stated that the Sanitarian will make a plan if there is a problem.   Mr. Meder stated that they didn’t test any private wells.  Chairman Cable questioned whether there is a normal procedure or if they defer to the Sanitarian.  Mr. Meder stated that a condition of their well permit approval is that there is no effect on neighboring wells.

Hearing no further comments, Chairman Cable called this Public Hearing to a close.

A motion was made by Jane Marsh, seconded by Stacy Winchell and voted unanimously to close the Public Hearing for the Special Permit Application to permit a Connecticut Water Company Well Station to be located at 216 Mile Creek Road.

2.      Special Permit Application to permit an addition to rear of the structure, construct dormers on each side of the structure, redo the front porch and other house renovations (i.e. siding, new roof, soffit over hangs on gables) on property located at 35 Ridgewood Road, Conrad & Angela Fongemie, owners, Larry Tomasetti, PHI Construction Services, applicant.

Ms. Marsh read the legal notice as published in the New London Day on January 27 and February 3, 2015.  She also read the exhibit list for the record.

Chairman Cable noted that this hearing was originally scheduled to be heard at the February Regular Meeting which was not held due to the snow storm.

Mr. Tomasetti submitted the mailing receipts for the record.  He explained that it is an existing single family home which they would like to renovate and update.   He explained that on the second floor one has to go through one bedroom to get to the second.  Mr. Tomasetti stated that they plan to move the staircase to the middle of the house and have separate entrances into each bedroom and also add a small bath upstairs.  He noted that the drawing shows the maximum floor area; the second floor is increasing 173 square feet.  He noted they are adding small dormers that go almost all the way across but do not come out far.  Mr. Tomasetti noted that the first floor staircase is being moved and a small addition off the back for the kitchen for an increase of 200 square feet which still brings the total under the maximum floor area allowed.  

Cable noted that here is a new drainage system going in.  Mr. Tomasetti explained that the outdoor shower is connected to public sewer.  Mr. Rosenfeld stated that the amount of drainage is pretty much the same so it was not referred to the Town Engineer.  

Chairman Cable noted that there are two doors.  Mr. Tomasetti explained that one door goes from the outside directly into the kitchen and the other from the outside directly into the existing bathroom.  He noted that they will be removing the exterior door to the bathroom.

Ms. Marsh noted that the application does not increase any nonconformities on this nonconforming lot.

The applicant noted that the house is not located in the flood zone.  He noted that the first few stairs of the porch may be in the flood zone.  Chairman Cable noted that the deck is on stilts and it’s the first few stairs that are in the flood zone.  Mr. Rosenfeld stated that it’s only the main structure that FEMA is concerned with as even a house on stilts needs to be accessed by stairs.

Ms. Bozek questioned whether there is a planned replacement walkway for the concrete one being removed.  Mr. Tomasetti stated that there is not currently, but possibly pavers in the future.  Ms. Bozek noted that there is also no driveway shown on the plan.  Mr. Tomasetti stated that the homeowners park on the grass in the summer.  Ms. Bozek stated that she thinks this has to do with total coverage, which could be exceeded.  She suggested a condition of approval that would limit future driveways and walkways to be pervious.  

No one present spoke in favor of or against the application.  Hearing no further comments, Chairman Cable called this item to a close.

A motion was made by Jane Marsh, seconded by Gil Soucie and voted unanimously to close the Public Hearing on the Special Permit Application to permit an addition to rear of the structure, construct dormers on each side of the structure, redo the front porch and other house renovations (i.e. siding, new roof, soffit over hangs on gables) on property located at 35 Ridgewood Road.  

Chairman Cable adjourned the Public Hearing at 7:53 p.m.
